Oklahoma Lawmakers Propose Urgent Civil Judgment Expungement Bill

UPDATE: Oklahoma legislators are urgently addressing the needs of financial abuse survivors by proposing a new civil judgment expungement bill. Representatives Andy Fugate (D-Del City), Toni Hasenbeck (R-Elgin), and Aletia Timmons (D-Oklahoma City) conducted an interim study revealing a critical gap in support for victims, who often find themselves trapped by unjust financial burdens.

The proposed expungement system aims to provide much-needed relief to those affected by financial manipulation and control. Currently, survivors face a daunting process to seal their records, requiring extensive proof and time—two luxuries they often do not have. As Hasenbeck noted, “For many survivors of abuse, civil judgments are not the result of poor choices but of manipulation, coercion or control.”

Financial abuse is a pervasive issue, with a staggering 99% of survivors indicating its presence in their experiences of violence. It manifests in various forms, including workplace harassment and coercive control over finances. As victims struggle to escape these cycles, they find their ability to secure employment and housing severely compromised.

Timmons emphasized the urgency of this measure, stating, “When victims of domestic violence have to move out of their housing to escape, civil expungement of evictions advances protections to some of Oklahoma’s most vulnerable.” This highlights the immediate importance of the proposed legislation in safeguarding the wellbeing of survivors.

Fugate added, “Anyone who works closely with domestic violence survivors knows escaping abuse is only the beginning.” With the emotional and financial scars left behind, the proposed “Survivors Act 2.0” could pave the way for a transformative shift, allowing victims to reclaim their lives without the burden of coercive debts.

As this situation develops, lawmakers will continue to refine the proposed expungement policy. The urgency for action is clear, and advocates are hopeful that this initiative will soon be crystallized into law, offering survivors a path toward recovery and empowerment.
