Homeless Man Waives Hearing on Bank Robbery Charges Today

UPDATE: A homeless man has waived his preliminary hearing on charges related to an attempted bank robbery in Upper Darby, Pennsylvania, just last month. Michael McGuigan, aged 49, originally from Philadelphia, faces serious charges following an incident on October 8, 2023.

The attempted robbery occurred at the Bank of America located in the first block of 69th Street. Authorities report that officers were dispatched to the bank at 10:32 a.m. after receiving a call about the robbery in progress. Upon arrival, officers encountered McGuigan standing outside the bank, fitting the description provided by witnesses.

According to the affidavit filed by Upper Darby Police Detective Mazen Malak, McGuigan admitted to the attempted robbery. Eyewitness accounts indicate he approached a teller and tried to force his hand through the customer service opening, demanding cash with the statement, “Give me the money.” When asked if this was a robbery, he confirmed, “Yes it is.”

McGuigan, represented by defense counsel Devon Potts, was initially scheduled for a preliminary hearing on November 6, 2023, before Magisterial District Judge Benjamin Johns. However, he entered a negotiated waiver on the two felony counts of robbery, with the understanding that the misdemeanor theft charge may be reinstated if a nontrial disposition is not reached at Common Pleas Court.

As it stands, McGuigan remains in custody at the county jail in Concord. His next court date is set for formal arraignment on December 31, 2023, at the County Courthouse in Media. This case continues to develop as officials prepare for the upcoming proceedings.
